INFORMATION COLLECTED
We collect personal information when you register with the Site and when you use any of our products or services. Personal information is any information about you that is personally identifiable, such as your name, address, email address or phone number, and any other information that is not otherwise publicly available.
In addition, if you send email invitations to friends and family and invite them to participate in Duncan & Stone, those email addresses are personal information.
If you order products or pay for services, we will need your shipping address, billing name and address, as well as your credit card number and expiration date.
Duncan & Stone may receive or obtain information (for example, an email address or IP address) about a person who is not yet a registered Duncan & Stone member (a “non-member”) in connection with certain D&S features, such as when a non-member chooses to subscribe to a D&S newsletter, a member invites a non-member to visit the Site, a non-member engages in a transaction, or a member sends a gift card code to a non-member, or a non-member makes a  purchase through one of the Services. Non-member information is used only for the purposes disclosed when it was submitted to D&S or to facilitate action authorized by the non-member. A non-member can contact D&S through the Contact Us page of the Site if they do not want D&S to retain their information.

MESSAGES FROM DUNCAN & STONE
On occasion, Duncan & Stone may need to contact you. Primarily, these messages are delivered by email or by push notifications, and every account is required to keep a valid email address on file to receive messages. D&S may need to contact you by telephone to provide member support or for transaction-related purposes if you give us permission to call you. Additionally, and with your consent, D&S may send you an SMS (or similar) message or physical mail in order to provide you with customer support or to provide you with information about products and features that you may find of interest. You may update your contact preferences in your account settings.
Some messages from D&S  are service-related and necessary for members and Guest Checkout users. You agree that D&S can send you non-marketing emails or messages, such as those related to transactions, your account, security, or product changes. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, service availability, modification of key features or functions, and correspondence with Duncan & Stone's support team.

For example, when you add additional authors to a journal, you send an email invitation to your selected authors which allows them to view and add entries to a journal. This email invitation contains a link created specifically for your journal. The email also may include information about special promotional offers from our Site.
If you use one of our referral programs to refer our Site to your friends and family, we will use their email addresses to send your invitation.
Please be assured that we do not use the email addresses that you enter through email invitations to send any type of direct marketing to your friends and family. (Of course, if a friend or family member signs up with our Site or we receive their email address from another unrelated source, we may communicate with them in accordance with this Privacy Policy.)
Your accounts may contain a journal where you can store birthdays, anniversaries, and other key dates and details about friends and family. This information is highly confidential and will not be shared with any third parties.
As we continue to develop our business, we may undergo a business transition such as acquiring another company, merging with an existing company, or selling all or a portion of our assets. In such transitions, customer information is typically one of the business assets that is transferred or acquired by a third party. If D&S intends to transfer information about you, D&S will notify you by email or by putting a prominent notice on the Site and the App, and you will be afforded an opportunity to opt out before information about you becomes subject to a different privacy policy.

If D&S receives a lawful, verified request for a member’s records or information in one of the limited circumstances described in the previous paragraph, D&S may disclose personal information, which may include, but may not be limited to, a member’s name, address, phone number, email address, and company name.


ACCESS TO YOUR ACCOUNT INFORMATION AND PREFERENCES
You have the right and ability to edit your member account information on our Site at any time. You can opt in or out of receiving future communications from us about special offers and new product information, you can unsubscribe by following instructions contained in the messages you receive, or you can change your marketing preferences by contacting us through the Contact Us page of our Site. We do reserve the right to send you certain communications relating to the services we provide, such as service announcements and administrative messages. We do not offer you the opportunity to opt-out of receiving those communications.

ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGAL ACTION. YOUR ACCESS AND CONTINUED USE OF OUR SITE SIGNIFIES YOUR EXPLICIT CONSENT TO THIS WAIVER.
